12.06 Sprinkler System Technical Drawings

(1)Preparation of technical drawings authorized by 528 CMR 12.01 when presented
to a building or fire official in order to obtain a permit to install a
sprinkler system as regulated by 780 CMR and M.G.L. c. 148 and not subject
to the practice of engineering (Professional Engineering Seal) as regulated
by M.G.L c 112 § 81D and authorized by M.G.L c. 112 § 81R(a),
a permit can be issued if the holder of a Fire Protection Sprinkler Contractor
license is certified as NICET Level IV Technician in Automatic Sprinkler
System Layout.

(2)Technical Drawings(s) prepared by the NICET Level IV Technician shall
indicate in addition to the Massachusetts Sprinkler Contractors License
number, the NICET Certification number as follows: (no special seals or
emblems shall be used)
Massachusetts licensed sprinkler contractor's name
Massachusetts sprinkler contractor license holder's name
Sprinkler contractor/license holder expiration date
NICET Level IV Certification number
NICET Level IV expiration date

(3)The NICET Level IV Certified Technician shall submit as part of the
technical drawings a copy of the NICET Level IV Certification.

(4)If the technical drawings prepared by the Fire Sprinkler System Contractor
NICET Level IV Technician are interpreted to be the practice of engineering
requiring a "Professional Engineering Seal" as regulated by M.G.L c. 112
§ 8D by the Building or Fire Official or other persons or entities,
and a permit to install a sprinkler system is denied, then those aggrieved
by such an interpretation may appeal to the Board of Professional Engineers
and Land Surveyors in accordance with the provisions of 250 CMR.

This regulation effective 10/3/97 limits the design build work to NICET
Level IV certified contractor license holders. Note that the license holder
must by the certified technician. This would not allow a contractor to
have a free-lance technician take responsibility for a set of plans. It
appears to require the license holder to take a higher level of personal
responsibility for design build jobs. However there is no rule keeping
a designer working for a contractor from getting a contractor license.
If this were to happen, the individual designer who layed the job
out would pull the permits and supervise the job.
